What Are The State Requirements?

 

"Financial  responsibility" is the legal and mandatory requirement which means that your minimum allowed policy liability limits are $25,000 per person, $50,000 per accident and $15,000 of additional property damage. These limits were raised in 2020, although consumers are still highly encouraged to consider amounts of $50,000 per person, $100,000 per accident, and $25,000 of property damage. Levels of $100,000 and $300,000 (an additional $50,000 of property damage) are required if you lease a vehicle. These benefits do not cover physical damage to your car or truck.

When pulling a trailer, generally, your liability benefits extend to the trailer. However, collision and comprehensive coverage (if applicable) are not extended without a rider or separate policy. If you loan your vehicle to a licensed driver, typically, coverage extends to the vehicle. If your vehicle is used for business purposes, a rider may be able to added to cover the increased risk. It's also possible that a commercial policy may be needed. Driving in Canada will probably not require any additional additions to the policy.

However, driving in Mexico is treated differently.
A separate contract must be written before driving in Mexico. The Republic of Mexico provides specific minimum requirements that must be contained in the policy. Although the existing US policy may provide limited coverage close to the border, driving without the required policy is never recommended. A large fine and/or a trip to jail could be the result if proper coverage is not active and compliant.

NOTE: In lieu of a personal car policy, you may  also transfer a $40,000 certificate of deposit to the State Treasurer's Office. Although legal, selecting this option is very unusual. Also, medical payments and uninsured motorist protection are optional benefits that are typically offered by most carriers. The Arizona Department of Insurance provides additional details.

Since obtaining coverage is mandatory, any lapse in coverage could result in a suspension and/or revocation of your driver's license and registration. The reinstatement process will involve several forms to be filed, possibly including an SR-22 Bond, which is an extra cost and must be maintained for three years.

You can "de-insure" a vehicle by terminating the required coverage on the car or truck that is not being driven. The Motor Vehicle Division must be notified to avoid a penalty and possible license suspension. An online certificate can be easily completed. Vehicle and operator information will be required.

During a traffic-stop or inspection, you will likely be asked to show proof of compliance. If you are operating your vehicle without coverage, once again, a suspension could result. NOTE: If you recently moved to the state and are covered by a company that is not approved or licensed to write AZ policies, you also are not compliant.

Transportation Network Companies (TNC) provide the opportunity for individuals to use their vehicles for hire and income opportunities. Uber and Lyft are the largest ride-share companies, although GRAB, GoCatch, GetAround, and ZipCar are viable options in other areas. Generally, when a driver is compensated for transporting a passenger, the personal auto policy does not provide coverage. Thus, incidents that occur during the travel to and from picking up the passenger are likely not covered. However, TNC companies that conduct business in the state, must provide coverage during this process.

The minimum required limits begin when the operator logs into the company operating system, and benefits are $25,000 per person, $50,000 per accident, and $20,000 for property damage. Once the ride request has been confirmed, or transportation is provided, the required limits increase to a total of $250,000 for bodily injury and property damage, and $250,000 of UM (uninsured motorist) protection.

Arizona Revised Statuses (28-4838), the driver, and/or TNC must provide the minimum limits shown above. A private or commercial company may be utilized. Higher limits are available and are highly-recommended.

Personal Umbrella Liability Policy

Typically, $100,000/$300,000/$100,000 are the minimum allowed limits if you consider purchasing a separate personal umbrella rider, designed to protect your assets from losing a lawsuit. The monthly cost of the rider is approximately $15-$25 for individuals and families. Business owners can obtain commercial versions, although prices are more expensive to cover employees who drive automobiles and perhaps operate machinery. If multiple boats or rental properties are owned, the premium will likely increase. Youthful drivers in the household may also impact the premium.

Although there is no "perfect candidate" for purchasing this type of contract, if you have a substantial 401k, rental properties, multiple CDs, sizable investment accounts, or other assets, an umbrella should be considered. You can protect yourself from a judgment that awards money for death, long-term disability, extended hospital confinement, and rehabilitation expenses that continue for years. Libel and slander are also typically covered. A deductible applies to all claims, typically $500-$2,500. Legal defense is provided, if needed. An out-of-court settlement is possible to avoid lengthy and expensive litigation.

AZ High Risk Coverage?

 

If you have been convicted of multiple moving violations, including a DUI, and/or have been involved in several at-fault accidents, there's a very good chance you are considered a "high risk." Although several companies will offer a policy, it is possible that you will not meet the underwriting criteria of most other carriers, and may be forced to look elsewhere. However, cheap high risk auto insurance rates can be found. Often, they are not the carriers you have previously utilized for covering other vehicles or your home and personal property.

After your policy has been active for 60 days, your policy can be terminated for many reasons, including misrepresentation, non-payment of bill, license suspension, vehicle is now used commercially, and major violations. A large number of minor violations (speeding, rolling through stop sign, driving through red light, etc...) can also result in a cancellation. A lengthy lapse in coverage may force a driver to seek coverage different than the company that previously issued the policy. If an accident occurs while driving without coverage, a license suspension is likely.

The State "Assigned Risk Plan"  (AAIP) was created to offer guaranteed coverage from the insurers that do business in the state. The minimum required liability limits are available, even if you have been declined by one or more companies. Plans are written by the companies that are licensed to do business in the state. Each year, there may be slight changes to the list.

Arizona participates in the Western Association Of Automobile Insurance Plans (WAAIP), which helps consumers find coverage for their vehicles after their policy has been cancelled. Rates are moderately-competitive, although continuous driving without tickets or accidents provides many more low-cost options. Once there are no incidents on your MVR, many additional carriers will offer their preferred rates, along with discounts you may have been previously ineligible for. Certified Ignition Interlock After License Suspension

 

When your AZ driver's license is suspended or subject to revocation, you may be required to have an ignition interlock system installed. Proof of installation from a company approved by the Department of Motor Vehicle Services is required. It's also possible that a duplicate driver's license will indicate the presence of the device. However, an active license is required for the installation.

This breath-analyzing device can be found on the dashboard, and is electronically monitored by the ignition system. The driver (and vehicle owner) must exhale into the device to start the engine. When a trace of alcohol is detected, the engine "locks up' and will not start. Once the vehicle starts, additional exhale tests must be performed showing a "no-alcohol" reading. If the test can not be completed, or the driver tests positive for alcohol, fair warning will be provided with flashing lights. At that point, the driver must shut the engine off or complete a successful test. Passengers, of course, can not complete or participate in the test.

Typically, the largest cities in any state have the highest premiums, and Arizona is not an exception. Although zip codes vary, prices in Phoenix are about 15%-30% higher than most other areas. The main reasons are the larger number of drivers without coverage, more thefts per square mile than most other areas, fairly expensive repair costs, and higher collection and claim costs for carriers that do business in Maricopa County and the surrounding area.

De-Insurance -- If your vehicle is not available to be driven on the road, you can obtain a De-Insured Certificate, which involves completing a form. Typically, within two days, it is approved and you do not have to cover the vehicle.

Insurance Information Request --  Suppose you were hit by another driver and they received a citation. Unfortunately they could not prove that they had compliant insurance. For $3 and a policy accident report, you can obtain specific policy details by submitting the Information Request.

Ordering your MVR (Motor Vehicle Record) -- If you have "permissible use," you can purchase a copy online and print a copy. Three and five-year records are available at a cost of $3 and $5 respectively. A notarized signature is required unless completed in-person at the BMV.

Vanity License Plates -- Purchasing personalized plates online is the quickest and most efficient option. After they are approved (no profanity allowed!), the cost is $25 for an application fee and an additional $25 renewal fee. Depending on the type of plate, you may need either one or two (front and/or back). You must be the owner of the vehicle to buy vanity plates.

Vehicle Inspection -- There are three "Levels" of inspection. Level 1 is very basic and utilizes the serial number of the vehicle. There is no cost to the consumer when  completed at BMV location. Level 2 costs $20 and is conducted if additional information may be needed. Level 3 costs $50 and is used for vehicles that are considered "salvaged."

Commercial License (CDL) -- There are three types of licenses available (Classic A, B, and C). A road test is required if you have never had a CDL license, or are upgrading classes. The maximum cost of the road test is $25 and you have three chances to pass the exam.
